  1. Introduction and Scope

    This Privacy Policy describes how Breakverse, Inc. collects, uses, shares, and protects personal information when you use Break. It applies to the Break mobile application and any associated services we provide that link to this policy.
    This policy does not apply to the practices of third parties whose content or services may appear within the app, or to any services operated by third parties even if linked from Break.

    By creating an account or using Break, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the App.

    We serve users primarily in the United States and India and comply with applicable privacy laws in each jurisdiction where we operate. This policy applies to all users regardless of location.

  2. Information We Collect

    2.1 Information You Provide
    • Identity information: Name, username, phone number or email address
    • Profile information: Date of birth (used to verify minimum age); gender and nationality (optional)
    • Profile photos: Images you choose to upload to your account
    • User-generated content: Text and photos you create and share within the app
    • Communications: Messages you send us when contacting support, including the contents of those messages
    • Survey and research responses: If you choose to participate in optional research or feedback requests

    2.2 Information We Collect Automatically
    • Activity data: How you interact with the app, features you use, and content you engage with
    • Connection data: Your social connections and interactions within the app
    • Derived data: Interests and preferences inferred from your activity, used only to personalize your experience
    • Engagement scores: Numeric indicators of your activity patterns used for personalization
    • Device information: Device type, operating system, app version, and unique device identifiers
    • Network information: Mobile carrier, network type, and connection status
    • Usage data: Session duration, in-app navigation patterns, and feature interaction frequency
    • Diagnostic data: Crash reports and error logs collected automatically
    • Log data: Access times, app version, and technical information about your use of the app

    2.3 Tracking Technologies
    Break is a mobile application and does not use browser cookies. We may use mobile analytics SDKs and similar technologies to collect usage and diagnostic data. These technologies help us understand app performance and improve your experience. They do not track you across third-party applications or websites.

    2.4 Information We Do Not Collect
    • We do not collect or store your contacts list. Any contact-based features operate locally on your device and process only data you explicitly provide.
    • We do not collect your location.
    • We do not track you across third-party apps or websites.
    • We do not build advertising profiles.
    • We do not use your data to train AI models.
    • We do not collect payment information. Break is free.
    • We do not collect biometric data.
    • We do not knowingly collect sensitive personal information such as health data, racial or ethnic origin, religious beliefs, sexual orientation, or political opinions. Please do not include such information in your content.

    2.5 Information About Non-Users
    If another user references you or shares information about you within the app (for example, as part of a connection request), we may receive limited information about you. We handle such information in accordance with this policy.

  3. How We Use Your Information
    We use your information to:
    • Provide, operate, and maintain the app and its features
    • Personalize your in-app experience based on your activity and preferences
    • Enable social and community features within the app
    • Authenticate your identity and secure your account
    • Send notifications about activity relevant to you (if you have enabled notifications)
    • Enforce our Community Guidelines, investigate violations, and protect users from abuse, harassment, and prohibited content
    • Conduct content moderation - user-reported content and flagged accounts may be reviewed by Breakverse personnel or automated systems
    • Detect and prevent fraud, abuse, and security incidents
    • Improve and develop our features using aggregated, anonymized data
    • Conduct internal analytics, research, and product testing
    • Comply with legal obligations
    • Respond to your support requests
    • Protect the rights, safety, and interests of Breakverse and our users

    3.1 AI-Powered Personalization
    Break uses AI to generate personalized content for your experience. Your content and activity data are processed by an AI system to surface relevant material. Your name, contact information, photos, and account identifiers are never used in this process. Your data is not used to train AI models. Anonymous keyword signals derived from your activity may be used to retrieve relevant third-party content - these signals contain no personally identifiable information.

    3.2 Automated Processing
    Break uses automated processes to personalize your experience. These processes do not produce legal or similarly significant effects about you, do not affect your access to the app, and do not result in decisions with legal consequences. You are not subject to solely automated decision-making that would significantly affect you. Contact us at company@breakverse.co with any questions about how our automated systems work.

    3.3 Content Moderation
    We use both automated systems and human review to enforce our Community Guidelines and maintain a safe environment. Content you post may be analyzed by automated tools and, where necessary, reviewed by Breakverse personnel. We do not read private content except where necessary for safety enforcement, responding to legal obligations, or resolving disputes.

    3.4 Safety and Security Enforcement
    If your account is suspended or terminated for violating our Community Guidelines or Terms of Service, we may retain information necessary to prevent you from creating a new account or to protect the safety of our community.

    3.5 De-Identification
    We may create de-identified or aggregated data that can no longer reasonably identify you. We maintain such data only in de-identified form and will not attempt to re-identify it. We may use and share de-identified data without restriction.

    3.6 Legal Basis for Processing (GDPR)
    For users in the EEA, UK, or Switzerland:
    • Contract performance: To provide the Break service (Art. 6(1)(b) GDPR)
    • Legitimate interests: Security, fraud prevention, abuse enforcement, product improvement, and operating the platform - where these do not override your rights (Art. 6(1)(f) GDPR)
    • Legal obligation: Compliance with applicable laws (Art. 6(1)(c) GDPR)
    • Consent: For optional features where you have provided explicit consent (Art. 6(1)(a) GDPR). You may withdraw consent at any time without affecting the lawfulness of prior processing.

  4. How We Share Your Information
    We do not sell your personal information. We do not share your personal information with advertisers. Break is ad-free. We share your information only as described in this section.

    4.1 With Other Users
    What other users see about you depends on your relationship with them and your privacy settings within the app. Content you choose to share is visible according to the sharing options you select. Certain profile information may be visible to other users as described in the app. You are responsible for the information you choose to share with other users - once shared, we cannot control how other users use that information.

    4.2 With Service Providers
    We work with carefully selected third-party service providers to operate Break, including providers of cloud infrastructure, AI content processing, application monitoring, analytics, and communications services. All providers are bound by data processing agreements requiring them to protect your information, process it only as directed by us, maintain appropriate security measures, and not use it for their own purposes. A current list of our service providers is available upon request at company@breakverse.co.

    4.3 For Legal Requirements and Safety
    We may disclose your information where required by law or where we reasonably believe disclosure is necessary to:
    • Comply with a legal obligation, court order, or lawful government or regulatory request
    • Protect the rights, property, or safety of Breakverse, our users, or the public
    • Prevent, detect, investigate, or address fraud, abuse, or security threats
    • Defend or establish legal claims or regulatory proceedings
    • Respond to law enforcement requests in compliance with applicable law
    We will notify you of legal disclosure requests where legally permitted to do so. We will not voluntarily disclose user data to law enforcement beyond what is legally required and will seek to limit disclosures to what is strictly necessary.

    4.4 For Child Safety
    We may share account identifiers with trusted industry child safety organizations for the purpose of detecting and preventing online child sexual exploitation and abuse (CSAM/OCSEA). This sharing is limited strictly to this purpose and conducted only with organizations maintaining equivalent data protection standards.

    4.5 Affiliates
    We may share information with current or future affiliates and subsidiaries of Breakverse, Inc., provided they handle it in accordance with this policy.

    4.6 Business Transfers
    If Breakverse is involved in a merger, acquisition, asset sale, financing, bankruptcy, or similar transaction, your information may be transferred as part of that transaction. We will notify you at least 30 days before your information becomes subject to a materially different privacy policy, and you will have the option to delete your account before any transfer takes effect.

    4.7 With Your Explicit Consent
    We may share your information for other purposes with your explicit consent, which we will obtain at the time of sharing.

    4.8 Aggregate and De-Identified Data
    We may share aggregated or de-identified information - which cannot reasonably identify you - with third parties for research, analytics, or product development purposes.

  5. Data Retention
    We retain your personal information for as long as your account is active or as needed to provide services to you.
    When you delete your account, we delete or anonymize your personal information from our active systems within 7 days, subject to the exceptions below.
    We may retain certain information for longer periods where:
    • Required by applicable law or regulation
    • Necessary to comply with legal obligations or respond to legal proceedings
    • Necessary to resolve disputes or enforce agreements
    • Necessary to detect and prevent fraud or abuse, including to prevent a terminated user from creating a new account
    • Retained in backup systems (typically purged within 90 days of account deletion)
    In all such cases, we retain only the minimum information necessary for the stated purpose.
    Specific retention periods:
    • Account and profile data: Deleted within 7 days of account deletion
    • User-generated content: Deleted within 7 days of account deletion
    • Connection and social data: Deleted within 7 days of account deletion
    • Diagnostic and crash data: Retained for 90 days
    • Usage analytics: Retained for 12 months in identifiable form; may be retained indefinitely in anonymized, aggregated form
    • Authentication codes: Discarded immediately after verification
    • Support communications: Retained for up to 3 years to resolve disputes and improve support quality
    • Safety and enforcement records: Retained as long as necessary to maintain platform safety
    Anonymized, aggregated data that cannot identify you may be retained indefinitely for product improvement and research.

  6. Your Rights and Choices
    Regardless of where you live, you have the right to access, correct, and delete your personal information. We honor these rights globally.

    6.1 Right to Be Informed
    You have the right to know what personal information we collect, why we collect it, how we use it, and who we share it with. This Privacy Policy provides that information. If you have questions not answered here, contact company@breakverse.co.

    6.2 Access and Correction
    You can view and edit your profile at any time through Settings. To request a copy of your personal data, email company@breakverse.co - subject line: "Data Access Request." We will respond within 30 days.

    6.3 Deletion
    You can delete your account at any time through Settings. This permanently deletes all your personal data within 7 days, subject to the retention exceptions in Section 5. Individual pieces of content may also be deleted without closing your account.

    6.4 Portability
    You have the right to receive a copy of your personal data in a structured, commonly used, machine-readable format. To request data portability, email company@breakverse.co - subject line: "Data Portability Request."

    6.5 Restriction of Processing
    You may request that we restrict processing of your personal information in certain circumstances, such as while you contest the accuracy of data we hold about you. Contact company@breakverse.co to make such a request.

    6.6 Non-Discrimination
    We will not discriminate against you for exercising any privacy right. We will not deny access, charge different rates, provide a different level of service, or take any retaliatory action as a result of exercising any rights under this policy or applicable law.

    6.7 Right to Object
    You have the right to object to processing of your personal information based on legitimate interests. You may also object to processing for direct marketing purposes at any time. Contact company@breakverse.co to exercise this right.

    6.8 Withdraw Consent
    Where processing is based on your consent, you may withdraw that consent at any time through your account settings or by contacting company@breakverse.co. Withdrawal of consent does not affect the lawfulness of processing prior to withdrawal.

    6.9 Notification Preferences
    You can manage notification preferences through Settings or your device settings at any time.

    6.10 Opt-Out of Analytics
    To opt out of analytics data collection, email company@breakverse.co - subject line: "Analytics Opt-Out." We will action your request within 7 days.

    6.11 California Residents (CCPA / CPRA)
    California residents have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:
    • Right to know what personal information we collect, use, and disclose - we do not sell
    • Right to delete personal information
    • Right to correct inaccurate personal information
    • Right to opt out of sale or sharing for advertising - we do not sell or share for advertising purposes
    • Right to non-discrimination for exercising privacy rights
    • Right to limit use of sensitive personal information - we do not use sensitive personal information beyond service delivery
    To exercise these rights: company@breakverse.co - subject line: "California Privacy Rights." Response within 45 days (extendable by an additional 45 days with notice). Identity verification may be required. Authorized agents may submit requests with written proof of authorization.
    Shine the Light (Cal. Civ. Code § 1798.83): We do not disclose personal information to third parties for direct marketing purposes.
    Appeal: If we decline a rights request, California residents may appeal by contacting company@breakverse.co - subject line: "California Privacy Rights Appeal."

    6.12 Washington and Nevada Residents
    Break does not collect consumer health data as defined under the Washington My Health MY Data Act or Nevada SB 370. Contact company@breakverse.co with any questions.

    6.13 Indian Users (DPDP Act 2023)
    If you are located in India, you have the right to access, correct, and erase your personal data, the right to grievance redressal, and the right to nominate a representative to exercise your rights in the event of your death or incapacity. Contact our Grievance Officer at company@breakverse.co. We will acknowledge within 48 hours and resolve within 30 days.

    6.14 EEA, UK, and Swiss Users (GDPR / UK GDPR)
    You have the following rights:
    • Right to be informed: To receive clear information about how your personal data is used (Art. 13-14 GDPR)
    • Right of access: To obtain a copy of your personal data (Art. 15 GDPR)
    • Right to rectification: To correct inaccurate personal data (Art. 16 GDPR)
    • Right to erasure: To request deletion of your personal data (Art. 17 GDPR)
    • Right to restriction of processing: To limit how we use your data in certain circumstances (Art. 18 GDPR)
    • Right to data portability: To receive your data in a structured, machine-readable format (Art. 20 GDPR)
    • Right to object: To object to processing based on legitimate interests or for direct marketing (Art. 21 GDPR)
    • Right to withdraw consent: At any time, without affecting the lawfulness of prior processing
    • Right to lodge a complaint: With your local supervisory data protection authority
    • Right not to be subject to solely automated decisions: Break does not make decisions about you based solely on automated processing that produce legal or similarly significant effects

    6.15 Other U.S. State Residents
    Residents of Colorado, Connecticut, Virginia, Texas, Oregon, Montana, Delaware, Iowa, Indiana, Tennessee, and other states with applicable comprehensive privacy laws have additional rights, including the right to appeal our decisions. Contact: company@breakverse.co. We will respond within 45 days (extendable with notice).
    Appeal process: If we decline a rights request, you may appeal within 30 days by emailing company@breakverse.co - subject line: "Privacy Rights Appeal." We will respond to appeals within 60 days.

  7. Children's Privacy
    Break is not intended for children under 13 (or under 16 in the EEA and UK, where applicable). We do not knowingly collect personal information from children under 13. Age is verified at registration, and users under 13 are blocked from creating an account at both the application and database level. We do not retain age-verification data that triggers a rejection.
    If you believe we have inadvertently collected information from a child under 13, contact us immediately at company@breakverse.co - subject line: "Child Privacy Concern." We will investigate promptly and delete any such information within 48 hours of confirmed identification.
    If you are between 13 and 18, please review this policy with a parent or guardian before using Break.
    For users in the EEA and UK: Break is not directed at users under 16. We do not knowingly process personal data of users under 16 without appropriate parental or guardian consent where required by law.

  8. Data Security
    We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, loss, or destruction, including:
    • Encrypted data transmission for all data in transit
    • Database-level access controls ensuring users cannot access each other's data
    • Passwordless authentication - no passwords are stored
    • Secure credential storage using platform-standard secure storage on your device
    • Server-side controls ensuring sensitive operations are never exposed client-side
    • Personnel access controls with need-to-know limitations
    • Regular security audits, penetration testing, and vulnerability monitoring
    • Incident response procedures for security events
    However, no method of internet transmission or electronic storage is 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security measures and improperly collect, access, steal, or modify your information. While we are committed to protecting your data using industry-standard safeguards, you use Break at your own risk with respect to threats beyond our reasonable control. Please take steps to protect your account, including using a secure email address and not sharing your authentication credentials.
    In the event of a data breach likely to result in a risk to your rights and freedoms, we will notify affected users and relevant supervisory authorities within the timeframes required by applicable law - including within 72 hours under GDPR where feasible, and in compliance with applicable U.S. state breach notification laws.

  9. International Data Transfers
    Breakverse is based in the United States. Use of Break from other countries - including India, the EEA, UK, Switzerland, or elsewhere - involves the transfer of your information to and processing in the United States, where data protection laws may differ from those in your country.
    For EEA, UK, and Swiss users: We rely on Standard Contractual Clauses (SCCs) approved by the European Commission as the legal mechanism for international data transfers. A copy of the applicable SCCs is available upon written request at company@breakverse.co.
    EU-U.S. Data Privacy Framework: Breakverse, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. In the event of a conflict between this policy and the DPF Principles, the Principles shall govern. To learn more or view our certification, visit https://www.dataprivacyframework.gov. Disputes related to DPF compliance may be referred to our designated dispute resolution provider. As a last resort, binding arbitration may be available under the DPF Annex I.
    For Indian users: Transfers comply with the Digital Personal Data Protection Act 2023 and applicable cross-border transfer rules.
    All third-party service providers receiving personal data from us are required to maintain appropriate data protection standards through contractual obligations consistent with applicable law.

  10. Third-Party Links and Content
    The app may surface content from and links to third-party sources and services. When you access third-party content or services, that party's own privacy policy and terms of service govern. We are not responsible for the privacy practices, data handling, or content of third parties. We encourage you to review the privacy policies of any third-party services you access through Break.
    Third-party content providers receive only anonymous, non-identifying signals when we retrieve content on your behalf. We do not share your personal information with content providers in connection with this retrieval.

  11. Intellectual Property in User Content
    Content you create and share within Break remains yours. By using Break, you grant Breakverse a limited, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the app and providing the services you have requested. This license ends when you delete the content or your account, subject to the retention periods in Section 5. We do not claim ownership of your content.

  12. Cookies and Tracking Technologies
    Break is a native mobile application and does not use browser cookies. We use mobile analytics and diagnostic tools to collect usage and performance data as described in Section 2. We do not engage in cross-app tracking or behavioral advertising. If you access any Breakverse web properties, those may use cookies as described in any applicable cookie notice on those pages.

  13. User Safety and Trust
    We take the safety of our community seriously. We use automated and manual means to detect violations of our Community Guidelines. We may cooperate with law enforcement in connection with investigations of illegal activity. We may share information about accounts that pose safety risks with other platforms or law enforcement where permitted by law and necessary to protect users. If your account is terminated for safety violations, we may take steps to prevent the creation of new accounts to protect other users.

  14. Do Not Track
    Break does not respond to browser Do Not Track signals, as no universally accepted standard exists. We do not track you across third-party apps or websites. Our analytics practices are described in Sections 2 and 3.

  15. Authorized Agents
    You may designate an authorized agent to submit privacy rights requests on your behalf. The agent must provide written, signed authorization from you and proof of their authorization.   16. Limitation of Liability
    To the fullest extent permitted by applicable law, Breakverse shall not be liable for any unauthorized access to your personal information that results from circumstances beyond our reasonable control, including but not limited to attacks by third parties, user error in protecting account credentials, or actions taken by other users contrary to our Terms of Service.
    Nothing in this section limits any rights you may have under applicable consumer protection or data protection laws that cannot be excluded or limited by contract.

  17. Governing Law and Dispute Resolution
    This Privacy Policy is governed by the laws of the State of California and the United States, without regard to conflict of law principles, except where applicable local law requires otherwise.
    Any dispute arising out of or relating to this Privacy Policy that cannot be resolved through good-faith discussion shall be subject to binding individual arbitration under the rules of a recognized arbitration body, except where prohibited by applicable law. You retain the right to bring individual claims in small claims court. Nothing in this section limits your rights under applicable data protection law, including your right to lodge a complaint with a supervisory authority.
    Class action waiver: To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to bring or participate in a class action, collective action, or representative proceeding.
    Arbitration opt-out: You may opt out of the arbitration provision within 30 days of first agreeing to these terms by emailing company@breakverse.co - subject line: "Arbitration Opt-Out." This opt-out does not affect any other provision of this policy.
    For EEA, UK, and Swiss users: Mandatory arbitration does not apply where prohibited by applicable law. You retain the right to seek relief from your local courts and supervisory authorities.

  18. Changes to This Policy
    We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will:
    • Update the "Last Updated" date at the top of this policy
    • Notify you through a prominent in-app notice before changes take effect
    • Provide at least 30 days' notice before material changes apply to existing users
    • Obtain fresh consent where required by applicable law
    Prior versions of this policy are available upon request at company@breakverse.co. Your continued use of Break after changes take effect constitutes acceptance of the updated policy. If you do not agree with material changes, you may delete your account before they take effect.
